Did I commit perjury?

I was recently arrested for a DUI in the state of Michigan.

During the court proceedings, I was asked by the judge if I had previous alcohol related incidents.

I simply replied no, despite having been arrested 30 years ago for the same situation.

Following the advice of my attorney, I was told that there was no way that the court could reveal incidents that happened more than a specific amount of years ago - 30 years definitely being enough.

Is this perjury?

Were you sworn in before you answered the question? If you did not swear, under oath, to tell the truth then you did not commit the criminal act of perjury.

You damn sure lied to the judge, though. Your attorney sounds like a piece of crap. If this was reported to the bar association, he could face significant penalties to include the suspension or revocation of his license to practice law. Attorneys are not allowed to lie to the court and we are not allowed to encourage, instruct or allow our clients to lie to the court.

You might want to consider hiring a new attorney. I guarantee to you that this isn't the first time your attorney has done something like this. And I guarantee that the prosecutor's office and the judges know this and don't respect your attorney. Attorneys who are held in low esteem by the court and the prosecutor are attorneys who are not able to get their clients good deals.
