How to get into Canada from US with a DUI?

My friend had expunged DUI < 5 years ago and they turned him away at the border because he had DUI even though it was expunged from the record.

I have a DUI from 10 years ago and wonder if that also bars me from going to Canada. If so how can I get over there to good old Canada for vacation?

Expungement doesn't necessarily mean that a record "disappears" altogether-what it means is that the record is no longer "publicly viewable"-which means that people like potential employers probably wouldn't find any record of the offense if they did a background check on a new job applicant.Generally expunged records are still available to law enforcement.

..Since 10 years have passed since your DUI you may fall under what's called "deemed rehabilitation"-that means that if you haven't had any more charges brought against you since then you MAY be considered "rehabilitated" and allowed to enter Canada with no issues.There is no "blanket rule " on this and each case is judged individually-the best thing to do is contact the nearest Canadian Consulate for clarification.(Read the link below from the Citizenship & Immigration Canada for more info...)

How can I get a DUI sealed or expunged from my record?

I was over 21 when I got it and am just wondering if it's possible to get it expunged from my record. or sealed. I live in California

Once you are convicted of a criminal offense it is on your record for ever. Even after you finish your sentence / probation, it is always going to be there. Any employers that run a Criminal History Report or DMV or other back ground check will find it.

The process of of getting a charged expunged means to have it removed from your public view criminal record. Police and other government agencies will still be able to find the past conviction, though.

Getting criminal charges expunged from your record is not an easy process. First you would have to see if your conviction even qualifies. Many do not.

You should start by contacting your state's Attorney Generals Office. They will tell you if by your state law the crime qualifies for consideration. You will then be instructed on what paper work must be filed.

You will need an Attorney to help you with the mounds of paper work and court appearances. This process will take months and maybe years and will cost you thousands of dollars.

It is not easy to do.

A DUI is normaly a misdemeanor offense. Many states do allow misdemeanor offenses to be expunged or sealed (sealed it where the court records are sealed so that it is not available to the public. It would make it like how juveninle records are, the public can not see them).

But, many states do NOT allow prior DUI convictions to be removed from your record... Or, if they do there is at least a 7 year waiting period. The reason for this is that DUI is a progressive offense, ie, each conviction carries a stiffer penalty. Again, you need to check with your state's Attorney Generals Office to see if it is eligible.
