Penalties for Uninsured Drivers
The basic level of auto insurance required to drive a car, van, pick up truck or SUV; includes Medical—Bodily Injury Liability and in most States Property Damage Liability. These types of insurance coverage will ensure that anybody who suffers harm or damage is protected. Where a driver is at fault for an accident that causes loss or injury to a third party, these policies should enable the injured parties to be compensated to rectify the situation and put them back into their original position.
Despite car insurance being mandatory and large penalties for not having the correct coverage in place, many drivers are prepared to take the risk and leave victims out of pocket should an accident occur. This creates the possibility of individuals turning to the state for assistance in the event of the uninsured driver being untraceable, though it is not their responsibility.
The Insurance Research Council (IRC) has provided data to show that as recently as 2009, one in seven drivers on the road had failed to obtain a valid auto insurance policy. This results in an increase of premiums for law-abiding drivers who keep the necessary coverage in place.
Rectifying this issue is the basis for constant debate, with harsher penalties being put in place to encourage drivers to make obtaining the required policy a priority. In the United States, the penalty for driving a car without the benefit of an auto insurance policy varies from state to state. In some cases, a fine will be payable and in other circumstances, this may be joined by the suspension of the driving license. For example in the State of New Jersey some of the punishments can be even harsher than those for drunk drivers. Even for the first offence of driving without sufficient insurance, the Municipal Courts can impose a suspension on the offender's drivers license and sentence them to community service. Second time offenders risk placing themselves in a position, where even if they are granted their license back they may effectively be unable to get auto insurance in the near future due to a penalty points system.
Driving without insurance has always been against the law, but many drivers are still prepared to take the risk, attracting the possibility of earning a punishment. The most severe penalty is actually the potential for a personal lawsuit. A consumer guide created in the State of Ohio makes it clear that wages being garnished and the cost of the accident being a life-long responsibility is a real possibility.
It is important that one of the first steps a driver takes after buying a vehicle is to seek insurance quotes to ensure coverage from the first moment it is used. The thought of saving money by going uninsured is not just irresponsible but will lead to heavy costs, as the eventual price to be licensed or drive will be so much more than the cost of an insurance policy.
