driving with open container (california)?

hey, i was driving and went through a stop sign. I got pulled over and when that happened, the cop saw an open 40 bottle in the back seat of my car. I was not drinking, but I got a citation for having an open container (while driving I guess) and Im under 21. Could I say that the alcohol wasn't mine or I didnt know it was there since I share the car? How big is the penalty for this usually?
