Should a DUI obtained in 2001 in California still be on someones driving Record?
My friend received a DUI in 2001 and when he went to court he was informed that it would come off his driving record in 7years but the law has changed in the last couple years and now it is 10 years. My question is? Should this still be on his driving record? Shouldn't the law that was in place the year he got the ticket apply and it have come off his record by now? Who would you go to, to be able to fix something like this?
To make this clear! I'm not asking about a criminal record I'm asking about his DRIVING RECORD
The case law in California has established clearly that the time within which a prior DUI conviction can be used to increase punishment is determined by the law in effect at the time of the SUBSEQUENT offense. So if he commits a DUI when penalties are greater if there is a prior DUI within 10 years, it does not matter that when he committed the first DUI the period of priorability was only 7 years.
