New Police Classes To Produce More Atlanta DUI Arrests

A brand new Police program is allowing police to arrest more people on Atlanta DUI charges.

 

As Law Enforcement scrapes the bottom of the barrel on Alcohol DUI enforcement, as it's hard to conceive of the legal limit going lower than 0.08, they are starting to concentrate on prescription and illegal drug DUI arrests. The objective of the Advanced Roadside Impaired Driving Enforcement program (ARIDE) is to furnish police with a broader mix of interpretations for the standardized roadside DUI tests undertaken on someone under suspicion of DUI in Atlanta. This training has triggered a rise in arrests of people suspected of driving under the influence of prescription or illegal drugs.. A key problem is that in Georgia, ingestion of illegal drugs (other than marijuana), is an automatic DUI, even with no evidence of impairment or detectable levels in your system. Prescription Drugs and Georgia Marijuana DUI only require the legal equivalent of proof of "less safe driving" or the equivalent legal standard "incapable of driving safely" to convict of DUI. georgia dui lawyer

What the ARIDE education includes is generally how somebody under the influence of prescription or illegal drugs could possibly execute some of the standard roadside tests that are given such as the one-legged stand, gaze test and the walk and turn. The ARIDE instruction provides police with an a broadened interpretation of the way prescription and illegal drugs may perhaps affect field tests like the nystagmous gaze test, balance tests and the appearance of the eyes and face.

 

The ARIDE Course then provides training on the seven drug categories and their symptoms and what field tests will indicate for their presence. The seven categories are: (1) Central Nervous Systems Depressants like alcohol and certain anxiety medicine; (2) Central Nervous System Stimulants like amphetamines and cocaine, (3) Hallucinogens like LSD or mushrooms; (4) Dissociative Anesthetics like Robitussin; (5) Narcotic Analgesicis like heroin, Lortab, Darvocet, and Oxycontin; (6) Inhalants like airplane glue and fingernail polish remover; and (7) Marijuana.

From the ARIDE Training website:

This 16-hour course is intended to bridge the gap between the SFST and DRE courses. You will learn how to observe, identify and articulate the signs of impairment related to drugs, alcohol or a combination of both. You will be given an overview of the seven types of drug categories and the physiological effects these drugs have on the human body. In addition, you will learn of medical conditions and other situations that can produce similar signs of impairment. The role of eye examinations in disclosing the possibility of drug impairment, and in suggesting the possible category or categories of drugs being used, will be discussed. You will receive the latest updates in Standardized Field Sobriety Testing. We will also explain the legal issues associated with impaired driving as well as pre- and post-arrest procedures. Note: This training will NOT qualify an officer to serve as a Drug Recognition Expert.

 

Its hard to image that with everything that a police officer must deal with on a daily basis, they'd be able to retain enough complex medical information from a 16 hour course to realistically begin charging motorists with prescription drug DUI's. Is this really a good strategy for improving public safety or a way to increase revenue through a broadened description of DUI testing?

 

The ARIDE program is simply an example of the growing scope of DUI law enforcement.
