public drunkenness citation in PA?
Two weeks ago I was walking home by myself from the local bar. I was two blocks away when a cop stopped me he asked me where i was going i told him home he asked where i had been and i told him he asked for my id and i gave him my military ID he asked if i had a state ID i told him no because it was suspended for a DUI he checked my info out and told me he was giving me a warning that i shouldn't be walking while i am drunk so then i asked him if he would ride me home and he did. This week I got a citation in the mail. He wrote that the incident happened on 2/16 but filed it 2/17 also no time was written and in discription wrote defendent was intoxicated and walking in a manner that would cause harm to her or others? People try to make the right decisions and still get in trouble, this community still gives fines for curfew violations. My question is should i fight it since he never wrote exactally what manner i was walking in that would have caused me harm & since theres no time
Make sure it's a citation and not a warning. A citation won't have a detailed description of what he saw. The incident report he filed will. An officer will state because of his training and experience you appeared to be intoxicated and a danger to yourself or others. Now you may be angry with this officer, but he was doing CYA. Do you know how many times an officer has seen an intoxicated female, done nothing, then found out she was raped or injured, then he was liable for not doing anything?
