If you've been accused of a crime, the whole world stops for you period. You simply cannot go on living your life as usual until you have been completely exonerated. If this is your first time dealing with the justice system, the process can be a scary one too.  In these circumstances if you would we hire a criminal defense attorney it would be beneficial.

A criminal defense lawyer is a lawyer specializing in the defense of individuals and companies charged with criminal conduct. Specifically, a criminal defense attorney defends those who have been accused of a criminal offense. Hiring a lawyer can be confusing process because in the New York region we can find many types of lawyers, that sometimes a person is unsure who would best represent them during their legal battle. Here are some useful tips you can follow while finding criminal defense attorneys that will best serve you or your loved one or your company.

1) Look for Specific, Relevant Experience

Find a law firm that concentrates on just a few types of legal matters, including criminal defense. For example, you might look for attorneys that have experience handling DUI, traffic ticket defense, probation violation hearings, and general criminal defense.

2) If possible ask your friends if they know any criminal defense attorney.   Explain them about your type of case if they know any criminal defense attorney collect the information from them. A referral is an excellent way to meet a good attorney.

3) Prefer the law firm if they were ready to offer free initial consultation. The consultation might be 10 to 15 minutes on the phone. Be bold with your attorney try to explain about your situation. If you're not honest with your attorney than it will have a negative impact on your case and also leads to extra burden on you financially. Don't choose an attorney who is not ready to offer initial free consultation.

4) Check the documents clearly about the fees structure, because the fee structure differs from attorney to attorney. So be clear about the financial aspects. An up front retainer fee after the initial consultation is usually required.

5) Execute a background check for the criminal defense lawyer. Determine if they belong to any legal organizations like the County or State Bar Associations. If the person is really a member of the National Association of Lawyers, then you are actually in excellent hands.

Memories: The Ties That Bind

My dad will be visiting me for the weekend. I'll meet him shortly after his plane lands at Bob Hope Airport. With a sharp smile and silver hair at 61, this year is destined to be a very happy and exciting period in his life. Just announcing his retirement last summer, he'll resign from his dental practice partnership based in downtown Duluth, sell his house and move to southward, along with my stepmom, to the very place I was born and raised; Alexandria, Minnesota.<!--more-->

Great! Now my family will live only 1,850 miles from my apartment. To be honest though, I found their move to be a little questionable at first. Alexandria is another speck on the map with not much to do except ice fishing, hunting, snowmobiling and getting drunk on occasion. Every resident, mostly Norwegian, knows each other by name and believes in the local legend of the town having been founded by Vikings. Sometimes I don't know how I managed to live there for 21 years. It's no place for an ambitious, cultured intellectual like myself. Of course, I got those traits from my father, which led me to ask him and my stepmom on more than one instance, "Why would you ever even consider moving to that sty of a town again?" He always gave the same answer; "Because we share the best memories of our family there."

His reason for moving back to my former hometown is kind of a difficult concept for me to understand at times, but as each week passes since the day I left my parents' sphere of influence for the first time in my life, the more I understand why my dad stands by it. Although I was used to living on my own during and after my college years in Duluth, my parents were settled only 30 miles north from where I was. My sister still resides in the Twin Cities, and all it took for me was a quick drive south on 1-35 to catch up with her. I don't have too many close relatives outside of the state and never lived as far away from my entire family as I am now.

At the time I announced my fateful job offer from my current employer based in southern California, every emotion imaginable dominated my parents; astonishment, happiness, gratitude, guilt, anxiety, fear, hope, acceptance, and finally topped off with faith. Every image and memory about me they held dear flashed before their eyes. The story about my recovery from autism takes anyone not familiar with it by total surprise. To them, I'm just another twenty-something trying to find his place in this complicated, evolving world of ours. Being a parent to a child with autism can be painfully difficult and heart-breaking to accept, but through constant prayer and perseverance, my mom and dad raised me above and beyond the high expectations of exceptional parenting, wishing and even demanding the very best out of anything I set my heart to. They appeared to be a little overprotective at times, but in doing so they displayed a strong symbol of tough yet unconditional love. Now that this incredible opportunity laid in front of me, flowing with numerous possibilities as vast and endless as the Pacific Ocean itself, I became aware of my parents' true intentions for me; The two and a half decades of delicate support and care gone into raising me had prepared us for this very moment. Now I had truly defied every assumption the medical professionals placed on me before my treatment at UCLA. The frightened little boy who couldn't speak, acknowledge his family or play with his toys suddenly grew into an independent and determined young man armed with dreams and ambitions for a establishing a better future for himself and his loved ones. Thus the circle of life continues to turn.

My dad and stepmom held back their tears of joy as they wished me well on my newfound journey of self-discovery. Though we are now separated in terms of geographic distance, we will never be separated in heart and spirit. Memories tie people together and make instances, both profound and subtle, seem like yesterday. Dad's decision to settle back in Alexandria is a choice I can fully encourage now. Watching a child defeat autism and develop into a matured individual with limitless potential is a wish that any family affected by ASD desires more than anything else, with makes me all the prouder to work for an ABA provider as determined and supportive as my family was to me.

What is the Difference between Civil and Criminal Lawsuits?

Civil lawsuits differ from criminal lawsuits in several very fundamental ways. It is important to understand these differences and how they impact your case. Regardless of whether you are facing a criminal or civil lawsuit, you will need the help of an experienced lawyer who regularly handles the same type of case you are involved in. Working with an inexperienced lawyer or representing yourself will greatly reduce the likelihood of a successful outcome to your case.

Civil vs. Criminal Lawsuits

Civil cases generally involve disputes between individuals or corporations and are filed when one party fails to carry out a duty that is legally owed to the other party. These cases often fall under the categories of personal injury law, business law, or real estate law.

Civil lawsuits seek resolution to the disputed issue in one of two ways:

  • By requiring the defendant to fulfill the duty for which he is legally obligated
  • By requiring the defendant to pay the victim financial compensation for damages suffered due to the breach in duty

Criminal lawsuits are filed by the government to hold an individual accountable for an action that is deemed harmful to society. In some criminal lawsuits, there may not be a specific victim of the alleged crime. For example, in the majority of DUI cases, there is no victim to the crime. However, since the intoxicated driver has violated a law intended to protect the safety of others, he still faces criminal charges.

Punishment

The consequences for a criminal conviction are generally much more severe than the consequences when found guilty in a civil claim. Punishment in civil lawsuits is strictly monetary. When found guilty, a defendant may be responsible for compensating the victim for all damages incurred. In situations where the defendant's negligence was egregious or represented malicious intent, punitive damages may be assessed as well.

While criminal convictions also frequently result in monetary fines, these fines do not go to compensate the victim. Instead, fines are paid to the government. In addition, criminal convictions may result in jail time depending on the nature and severity of the crime.

Burden of Proof

Since the penalties for a criminal lawsuit are more severe than those in a civil case, the burden of proof is also stricter for criminal cases. In criminal lawsuits, the government must prove that the defendant is guilty beyond a reasonable doubt. This criterion requires that the defendant is almost certainly guilty for a conviction to be secured. In contrast, civil lawsuits only require a preponderance of the evidence to find the defendant guilty. In other words, if the jury believes that there is more than a 50% chance that the defendant was negligent, the plaintiff will most likely win. Clearly, this standard is much lower than what is required in criminal cases.
