Receiving Jail Sentence for Misdemeanor

One of the first things that you have to determine is whether or not it is a misdemeanor or a felony. Each theft sentence is different from person to person. For example, if this is a first time offense and it is a misdemeanor, you should get a minor penalty, through a fine, restitution, or community service. Every now and then, if the victim feels like they have been compensated for their losses, then the judge will dismiss the theft sentence entirely.

A felony can be possible with each theft sentence if it exceeds a certain value determined by your local and state laws. Anything with a potential of 1 year or more of jail time is considered a felony. Also, any crime that uses force like a robbery is considered a felony.

Before a theft sentence is handed out, a judge will oftentimes use the "3 strike laws". Depending on the state, if a defendant commits a third felony, then he will automatically receive a longer prison sentence. The thief could possibly get 25-years-to-life or a double term. Once again, if you think someone you know or love has committed a felony, it is best to contact a criminal defense attorney so that they can give you the proper strategies that you need.

As mentioned, misdemeanors are considered to be lesser criminal actions. Even though they are not as serious as other crimes, however, they will still go on your criminal record and they will not go unpunished.  Depending on the charge, a misdemeanor can prevent someone from being accepted into school, from receiving a loan, from renting an apartment, or from getting a job.

While misdemeanor classifications vary from state to state, the following are typically considered to be misdemeanant actions:

• Public intoxication
• Petty theft
• Prostitution
• Disorderly conduct
• Vandalism
• DUI
• Drug possession

Misdemeanors are further subcategorized depending on severity. Again, this is done so by the state. Therefore, a crime holding much weight in Texas, for example, may not be considered as severe in a different state, like Illinois.

Felonies

As opposed to misdemeanors, felonies are considered to be much more serious criminal acts. Offenders face at least one year in jail, although the worst felonies may be punished by life in prison or even death, if the state supports capital punishment. Those convicted of felonious actions will also face much steeper fines.

Again, like misdemeanors, felonies are classified on a state-by-state basis. However, the following are almost always considered felonious:

• Grant theft
• Robbery
• Rape
• Aggravated assault and battery
• Murder

Facing a DUI But You Still Need to Drive?

A PA Occupational Limited License Can Give You the Ability To Continue Driving

If you have a non-commercial driver’s license that has been suspended or that will soon be suspended as a result of a DUI in PA, you may be eligible for a PA occupational limited license, or OLL. With a PA occupational limited license or OLL, you will be allowed to drive under limited circumstances, including:

• To/from work
• To perform duties necessary for your occupation or trade
• To/from medical treatment
• To/from school or purposes related to your education

Eligibility for a PA occupational limited license will depend on a variety of factors.  PennDOT frequently denies applications for OLL’s on the basis that there was a refusal to submit to chemical testing or as a result of a prior DUI offense. An individual who has been convicted of a first PA DUI offense is not eligible for an OLL until the individual has served at least 60 days of the license suspension.      

To get a PA occupational limited license, you will have to:

• Complete PennDOT Form DL-15, otherwise known as the Occupational Limited License Petition
• Send in the completed form along with the corresponding fee
• Wait to be approved by PennDOT for the license
• Take the OLL camera card you receive from PennDOT to the nearest Photo License Center so you can have your photo taken and receive your OLL

Person On Bicycle Lost Life After Being Hit By Drunk Driver

Last week in court, the family members of a young man killed by a drunk driver were able to watch as the person who took the life of their son was sentenced to five years in prison for vehicular manslaughter while under the influence of alcohol. It had not been long since the young man now deceased had graduated from high school and completed training at a school for massage therapy. He was also a well-known, talented musician in the Carmel area where he lived. On a night in February, the young man was riding home on his mountain bike when he was struck by a drunk driver. Apparently, the man’s state of intoxication was so severe that he didn’t realize immediately what he had done. Therefore, he drove away from the scene, leaving the young and injured bicyclist to die alone on the roadside. He was discovered at approximately 7 A.M. by several Carmel residents on their way to work.

The man driving the car was a successful marine biologist and avid underwater photographer who seemed to enjoy life and take his career seriously. It is unfortunate for the family members of his victim, however, that he did not consider drunk driving laws and the possibility of injuring or killing someone in his intoxicated state as seriously as he did marine life. The morning after the accident, the man phoned police and told them that he may have had something to do with a bicycle accident the night before. When police arrived at the man’s home, the bicycle on which his young victim rode was lodged in the front bumper of his vehicle. The young man’s backpack was also present, stuck between the wipers on the windshield. It is amazing that the driver was even able to make it home the night before with his vehicle in such horrific condition.

Blood alcohol tests were conducted and it was determined that levels of alcohol in the man’s system exceeded .17 percent. This is over twice the legal amount for those driving, and these tests were not even conducted until at least seven hours following the accident. It turns out that the man had been convicted of DUI in at least two other states and had also been convicted of being drunk while in public. Despite his past wrongs, the man was only sentenced to five years in a California prison. In a civil case, he was required to pay approximately one million dollars to the family members of his fatal victim.
