MARIO UDASCO DALO v. COMMONWEALTH OF VIRGINIA

On the evening of October 5, 1999, appellant was driving on Shore Drive in the City of Virginia Beach when he struck James Cone and Kathy Phelan. Cone was injured, but not fatally. Phelan was alive at the scene, but later died from her injuries.  When Virginia Beach Police Officer Scott Bishop arrived at the scene, he found appellant's speech was slurred, his eyes were glassy, and he swayed as he stood. Appellant also smelled of alcohol and could not pass a number of field sobriety tests. Appellant admitted he had consumed alcohol that evening. A breath test revealed his blood alcohol level was .11.  Appellant was charged with involuntary manslaughter under Code § 18.2-36.1(A) and with DUI.  The DUI warrant originally recited a violation of the Virginia Beach City Code. The prosecutor amended the warrant to reflect a violation of Code § 18.2-266(ii), (iii), or (iv). The language on the DUI warrant that referred to Code § 18.2-266(i), allowing convictions based on a blood alcohol concentration of .08 or more, was struck by the prosecutor. The district court convicted appellant of the amended DUI charge and certified the manslaughter charge to the grand jury.  In the circuit court, appellant moved to dismiss the indictment on double jeopardy grounds. After both parties briefed the issue, the trial court heard argument and denied the motion to dismiss.

Whether double jeopardy prevented defendant's conviction of both crimes required examining if the legislature intended to impose multiple punishments for these crimes?

The court finds that the defendant who was convicted of DUI under Code § 18.2-266(i) clearly can be convicted of involuntary manslaughter in violation of Code § 18.2-36.1 without violating double jeopardy principles.  Further the two statutes proscribed the same conduct did not mean the double jeopardy clause precluded the imposition of cumulative punishments. A comparison of § 18.2-36.1 and several murder statutes indicated the general assembly's intention to allow multiple punishments, similar to allowing conviction for both felony murder and the underlying felony. Defendant could clearly be convicted of both driving under the influence under Va. Code Ann. § 18.2-266(i) and violating § 18.2-36.1, and there was no indication the legislature did not intend to treat violations of Va. Code Ann. § 18.2-266(ii), (iii), and (iv) similarly.

Conclusion:

The General Assembly clearly intended to allow multiple punishments in this case. For the reasons stated above, we affirm the conviction.

What are the penalties of underage drink driving?

I need to know for a novel that I'm working on-

If a fifteen year old girl drink drives resulting in the death of two people, and in turn suffers retrograde amnesia from the crash, causing her to completely forget her past except for the first four years of her life and become a completely different person who is much more shy and law abiding, what penalties would she receive? Would she have to do community service at all?

The law make it illegal for a person under the age of 21 to operate a motor vehicle with any alcohol in his system

In some states, the penalties are administrative, with an automatic license suspension but no possibility of jail time or criminal conviction. In others, however, underage drivers who have been drinking are charged with DUI or a related crime. Under both civil and criminal statutes, penalties are typically more severe for subsequent offenses, and breathalyzer test refusals are often treated in the same manner as measured violations.

In addition, underage drivers subject to zero tolerance prosecutions are often charged with additional crimes such as consumption of alcohol by a minor or possession of alcohol by a minor.

Why a Virginia DUI Case Needs a Virginia DUI Lawyer

DUI change in California blood test taken 5 hours after arrest?

I was arrested for a DUI after an accident. I admitted to drinking 2 beers. I refused a Breathalyzer after the first one right after the accident. I also said that my nerves were shot after the accident to do a field test. The police still made me do one. I agreed to a blood test and took a blood test 5 hours after being arrested.

I keep looking at the laws and they state that the blood test needs to be taken within 3 hours after arrest.

Is this true? Could I get the charge dropped because of this?

Look I know what I have done and have already started a recovery program because of it. Not just because I convicted. I am just really scared that I will lost a career that I have worked on 6 years to make possible.

You are misreading the law. What it says if that if your blood tests at .08% or more within 3 hours of driving, it is presumed that your BA was .08% at the time of driving (Veh C sec 23152(b)). (This is to deal with the problem that your BA continues to rise for a period of time after drinking.) However, that does not make a test administered over 3 hours later invalid, nor are the charges going to be dropped. It is most likely that if you were .08% five hours after arrest, you were at least .08% when driving unless you drank a WHOLE lot just before you were arrested.

BTW, the person who said you have a "right" to refuse a test is correct only up to a point. There is no legal effect to refusing an in-the-field PAS (preliminary alcohol screening) test (which is not a Breathalyzer), but if after arrest you refuse to take a blood test you will lose your license for a year (even if you later agree to take one). So you can refuse the test, IF you are willing to accept the consequence.
