Got Stopped by Police – Drunk Driving Trouble

Most drunk driving cases start out with a contact between the driver of a motor vehicle and a police officer. While the police have the right to approach and speak with any citizen, they do not have the right to detain and investigate a citizen unless they have "probable cause".

Probable cause is the legal reason an officer needs to detain and investigate. If the dui attorney can show to the judge the officer did not have probable cause, the case can be dismissed.

Most detentions begin with the officer pulling over a driver who has committed a vehicle code infraction. The common reasons alleged by the police are based on poor driving - speeding, weaving within or outside the lane, running of a stop sign or red light. However, faulty equipment (head light, tail light, muffler) or expired registration will provide the necessary reason to pull a driver over. A driver involved in an accident or in a car blocking the roadway may also give the officer the right to detain and investigate.

It is therefore important to discuss with the dui attorney the manner of driving. If the driver was acting legally, or if the officer did not see the driver actually operate the vehicle, the case may be dismissed. Not only does the officer need probable cause to detain and investigate, there must also be a legal reason to arrest. The officer will make his decision to arrest based on two or three factors: his observations, the field sobriety test, and in some jurisdictions, a breath test conducted in the field.

Sad DUI Story

He had been to a company party and had a bit too much to drink, when it was time to leave the party, he knew that he had consumed a lot of alcohol but he was sure that the short 15-minute drive home would be just fine. So, rather than calling a cab, he got behind the wheel of his car and began driving home. As with most people who drink and drive, his judgment was impaired and in just a matter of minutes, he had smashed into a parked car. Fortunately, no one was in the car when it happened, but the consequences and the damage to his life were irreversible.

When the police stopped him his blood alcohol level was 0.1, way over the legal limit of .08 and so after being arrested, and admitting his guilt, he was soon sentenced for his crime, only to discover that things were going to be far worse than he expected. Not only did he have to serve weekend time for his DUI conviction, but also in addition, his job was in jeopardy and his license was suspended for a year.  While the young man above was basically an upstanding citizen, he like so many people who drink and drive, just didn’t realize how dangerous it could be. Now in just a matter of moments, he was faced with the humiliation of having a record and losing his job as well as his license, all because he used poor judgment when getting behind the wheel of his car after drinking. Each and every day, this same type of event happens to thousands of people who without thinking put their lives and the lives of others in jeopardy. Not only can life become a mess when drinking and driving, but also the emotional, physical and financial damage caused by one experience of drinking and driving is staggering. A DUI not only impacts on the life of the person who was drinking and driving, but it has repercussions that affect the lives of all those who rely on the person who committed the DUI. Besides the threat of jail time, loss of a driver’s license and possibly all driving privileges, other consequences include a huge increase in insurance if not cancellation, high fines, potential loss of a job and the embarrassment of a record.

No matter how much you may think that having one or two drinks before driving is okay, if you have an accident and are charged with a DUI or DWI, the consequences are going to be very severe. The risks are far too great and the damage you can do to your life is simply not worth it. A DUI conviction may disappear after a few years, but a DUI criminal record will stay on your record forever. If you plan on drinking, call a taxi or get a ride when you get ready to leave a party because drinking and driving simply don’t mix.

Uganda is not your ordinary safari destination, it is a country very rich in fauna and flora which are seen in the 12 national parks in the country. Uganda has both large and small animal species which include primate, carnivores, and herbivores which include antelopes; both large and small antelopes.

Primates are exceptionally well represented in Uganda and these include the gorilla that is the mountain gorillas, the chimpanzee. The chimpanzee is closely related to humans than any other living creatures, monkeys. These fall into categories of five namely; baboons, patas monkey, vervet monkeys, blue monkeys, red tailed monkeys, de braza's monkeys. L'Hoest's monkey, grey checked mangabey, black and white colobus, and red colobus.

The lion, the largest African carnivore, the leopard commonly sighted in Kidepo national park and Murchison falls national park, cheetah also seen more often in the wildest Kidepo national park. Uganda has also small cats including; caracal, African wild cat, canids, Jackals, bat eared fox, African hunting dog. Other carnivores found in Uganda are, spotted hyena, African civet, genets, otters, mongooses and ratel,

Uganda has 29 antelopes species namely; common eland, greater kudu, hartebeest, defessa waterbuck, roan antelope, Uganda kob, bushbuck, sitantunga  commonly found in swampy areas, lesser kudu, grant's gazelle, reedbuck, Impala, grey duiker, Forest duiker, beate's pygmy antelope, klipspringer, Oribi and Guenther's dirk dirk

Other herbivores found in the country include the elephant, the world's larges t animals and the most intelligent and entertaining to watch. Rhinoceros, Hippopotamus, African buffalo, Giraffe, burchell's zebra, warthog, Hyraxes to mention but a few.

Bird life in Uganda is so great no wonder it is said to be the paradise of birds having over 1000 bird species including;  African Skimmer, Black Rumped Button Quail, Verreaux's Eagle Owl, Red Footed Falcon, Lesser Flamingoes, Grey Capped Warbler, White's and Abdim's Storks , Amur Falcon, Ovampo Sparrow hawk, Wooly-necked and Saddle-billed Storks, Vultures and Plovers the Great White and Pink-backed Pelicans, Great and Long-tailed Cormorants, Open-billed Stork, African Jacana, Malachite and Pied Kingfishers.  Bwindi  Forest is a home to 350 bird species, 23 bird species endemic to the Albertine Rift, and at least 14 bird species recorded nowhere else in the country, among them the African green broadbill, white-tailed blue flycatcher, brown-necked parrot, white- bellied robin chat and Frazer's eagle owl  Uganda also has reptiles namely; the amazing huge rock-Python, Puffadders, Spitting Cobras, Gabon Rippers, Green Mambas, Turtles and the Nile Crocodiles which are the largest crocodile Africa has left.

Regarding Calif house arrest?

My son (adult) sentenced to 30 day house arrest for DUI in Northern Calif. He lives in So Cal to attend school. Break at school is 2 weeks and if he misses 2 weeks of school, he will flunk quarter. He was told he must serve in No Calif, but am wondering, is it possible to serve 2 - 2 week sentences? Wondering if he might be able to do this on next school break and the one after that. Haven't heard back from his lawyer. Just wondering if anyone has had similar situation.

No i dont think it is possible. You have to speak to the judge about it.
If he serves time in SOUTHERN CALI he would only serve a fraction of what they give him because the jail In LA county is crowded. The most he will do is half his time. He has to serve tigome in LA county or Weyside. I got a 60 day sentence and served 23.
