Pedestrian Accidents and Fatalities: Taking Steps to Keep Pedestrians Safe

When we think of car accidents and other motor vehicle accidents, we tend to think only of the vehicles involved in the accidents. However, in 2008, the National Highway Traffic Safety Administration reports that 69,000 pedestrians were hurt in motor vehicle accidents and 4,378 pedestrians died in those accidents. Pedestrian deaths accounted for 12 percent of all motor vehicle crash deaths.

I have represented many pedestrians who have been hit by cars or trucks. I have been successful in winning compensation for the injuries my clients have suffered. The drivers were at fault and we rightfully held them accountable for injuring my clients. Nonetheless, each of those clients would have preferred that the accident never occurred. As pedestrians and drivers, we can all take steps to improve pedestrian safety.

Risk Factors and Pedestrian Accidents

Studies reveal several facts about pedestrians hurt in motor vehicle accidents:

  • According to the National Highway Traffic Safety Administration, 72 percent of all pedestrian fatalities occur in urban areas. This finding makes sense since there are more pedestrians in these areas. Last year (2009) was a bad year for pedestrian fatalities in New York City. While overall traffic fatalities decreased to 256 deaths, the lowest ever recorded, pedestrian fatalities increased from 151 to 155.
  • In 38 percent of pedestrian deaths, the pedestrian had a blood alcohol count (BAC) of .08 or higher, meaning that 38 percent of victims were legally drunk. Just as you should never drink and drive, you should not walk in congested areas when you've been drinking.
  • Pedestrian accidents are most likely to occur from 6 p.m. to midnight, meaning at dusk or night. Friday and Saturday nights see more pedestrian accidents than any other time.
  • The majority of pedestrian fatalities occur at locations other than intersections. These non-intersection fatalities tend to occur either on highways or interstates or in non-crosswalk areas where pedestrians may walk into the road at a location where drivers do not expect to see them.
  • Elderly residents are particularly vulnerable to pedestrian accidents and fatalities. The New York Post found that "although people from 60 to 75 make up just 17 percent of the population in New York City, Westchester County, and Long Island, they account for 42 percent of pedestrian fatalities." The National Highway Traffic Safety Administration reports that in 2008, the pedestrian death rate among those 70 and older was 22 per million people, 61 percent higher than the death rate for those younger than 70.

 Improving Pedestrian Safety

The statistics suggest ways to reduce pedestrian accidents:

  • Better road design
  • Better traffic enforcement
  • Better decision-making by pedestrians

The Federal Highway Administration has established a focused plan to reduce pedestrian fatalities in select areas, including New York State and New York City. You can read more of their plan here. Better Road Design Will Save Pedestrian Lives

A 2003 study published in the American Journal of Public Health found three categories of road design improvements that can reduce pedestrian accidents:

  • Separate pedestrians and vehicles: Pedestrians and vehicles don't mix. By creating structures and systems to keep them apart, we keep pedestrians safer.
  • Increase the visibility of pedestrians.
  • Reduce vehicle speeds in areas where there are likely to be pedestrians.

In one example of better road design, safety has improve thanks to structural changes at the intersection of 9th Avenue and 23rd Street in New York City, near the Penn South housing complex with many elderly residents. The New York City Council is working with the AARP to make other street improvements that will enhance pedestrian safety. You can read more at Streetsblog.

Better Traffic Enforcement Can Save Pedestrian Lives

Traffic enforcement can make a difference in two key ways. Vehicles that abide by speed limits are less likely to be involved in a pedestrian accident or any other type of motor vehicle accident. More importantly, enforcing traffic rules at intersections and crosswalks will save lives, particularly lives of the elderly who tend to cross more slowly.  We do not need new laws much as we need to ticket cars that block or illegally enter crosswalks, run red lights or roll through stop signs.

Better Education and Making Better Choices

The Insurance Institute of Highway Safety issued a 2002 report that claimed, "Pedestrians were more likely than drivers to be judged at fault in these collisions (50 percent versus 39 percent with the remainder being either shared or unknown fault)." Simply put, by making better choices, pedestrians can reduce the chance of an accident.

According to a study published in England, public education programs have little effect with pedestrians, except for children. Children benefit from programs that stress crossing at the corner, looking both ways and using caution around cars. Education programs for children have reduced pedestrian fatalities.

For the rest of us, we should follow a few simple rules:

  • Don't drink and walk.
  • Cross at the corner, not in the middle of the road.
  • Use sidewalks whenever possible.
  • When walking on the side of the road, face traffic and stay as far out of the traffic lane as possible.
  • If stuck on an Interstate or freeway, pull as far off the road as possible and stay in your car. Use a cell phone to call for help or put a white handkerchief on your door handle. If you decide to walk along the highway – where cars travel at tremendous speeds and do not expect to see a pedestrian – you are dramatically increasing your chances of being hit by a car.
  • If possible, avoid walking during dusk or after dark.
  • Do all you can to make yourself visible. If you must walk at dusk or in the dark, wear reflective materials, carry a flashlight and try to walk in well-lit areas. When I go walking or running, I wear a reflective vest and carry a tiny flashlight.

Always give cars the benefit of the doubt. The driver may be wrong, but if that car hits you, you will lose. If we are out walking, we need to do all we can to ensure our safety.

A Review Of Auto Insurance America

Auto Insurance America is an insurance company serving Arizona, Nevada, and New Mexico; they provide renters insurance, automobile insurance, watercraft insurance, motorcycle insurance, RV insurance, mobile home insurance, and homeowners insurance.

The company has been in business since 1972 and offers automobile insurance for both "clean record" drivers and those with less than stellar driving records.

Because the company has been around so long with the same management, it's impressive that they can be a reasonably priced insurance company with competitive rates even as compared to more cut-rate companies.

An Overview

Auto Insurance America is a good basic company with decent coverage no matter who you are. They also offer special coverage for those with DUI records, something many insurers don't do. Additionally, they offer senior citizen discounts and special "monthly birthday discount" pricing for those under 30 who normally have to pay higher rates.

You do have to be careful to read policy requirements, because, for example, some have complained that their policies have been canceled for car-pooling, or have complained that customer service is less than stellar. Nonetheless, these are practices many companies follow in that if you're carpooling, for example, you may not have coverage for everyone driving or using your vehicle.

Therefore, specific types of coverage may have you as the only one able to drive your car if that's the insurance policy you chose. As to customer service, many people are cutting back on customer service costs as a means to save money. This is a trend across the business industry, not just insurance, and therefore customer service problems may be more apparent across the board then was once true.

Be careful to check rates and do some comparison-shopping

Although Auto Insurance America does have decent rates for most people, do comparison shop between companies even so. You may be able to find better coverage for less money, although some of the amenities Auto Insurance America offers may not be available at these rates from other companies, such as coverage for those with drunk driving convictions or special "discount" rates for young drivers.

Convenience of being able to pay your bill online

As with many auto insurance companies today, Auto Insurance America allows customers to pay their bills online, which is convenient and easy to do.

The bottom line?

Auto Insurance America is a decent company with a good customer service record, although these days, customer service may leave something to be desired simply because of the cost cutting measures the company is trying to implement. Because customer service has taken a bit of a back seat, customers have to be especially vigilant that they read policy requirements carefully and follow them to the letter.

Sudden cancellation of policies for things consumers didn't know were forbidden previously (such as the aforementioned carpooling restriction) does happen, and the company does not necessarily warn beforehand. Therefore, be proactive if you do take out a policy with Auto Insurance America, because you're going to have to know the fine print to make sure you don't violate anything in your policy.

How Restrictions, Suspensions And Revocations Affect Your Chances At Driver's License Restoration

The differences between restrictions, suspensions and revocations are important to understand.

A restricted driver's license limits driving privileges.  A suspension is a temporary loss of a driver's license for a certain time period. Revocation is a permanent loss of driving privileges.

The Secretary of State can restrict, suspend or revoke driver's licenses for multiple reasons. Common grounds include:

  • Multiple DUIs (also known as a habitual offender). Your driver's license is suspended for 1 year after 2 DUI convictions within 7 years. Licenses are suspended for five years after three DUI convictions. A person who has a revoked license because of multiple DUI convictions must wait until the revocation period ends before seeking a hearing to restore his license.
  • Refusal to take a chemical test after an arrest for DUI (also referred to as implied consent). This results in a one year suspension for the first refusal and a two year suspension for a second refusal within seven years.  Only first refusals are appealable to the circuit court on a hardship basis in Michigan.

Other reasons include:

  1. Too many points as a result of multiple traffic tickets.
  2. Probationary driver violations. This may happen when a probationary driver incurs either traffic accidents or traffic tickets.
  3. Restricted license violations. This occurs when a person drives outside of their restrictions. For example, if a person is restricted to driving only to and from work and the person is caught driving to a party, this would constitute a violation.
  4. Mental/physical disability resulting in unsafe driving.
  5. Out-of-state convictions for drunk driving and the like.
  6. Driving with a suspended/revoked license.
  7. Too many car accidents.

Importantly, suspension and revocations are treated differently when it comes to hardship appeals in the circuit court. The hardship appeal permits the petitioner to request a restricted license so that, for example, he or she may drive to and from work. Suspensions are appealable on hardship grounds to the circuit court.

Revocations are a different story.  Revocations from arrests before October 1, 1999 are appealable to the circuit court; revocations after that date are not appealable. In other words, an arrest for driving while license revoked after October 1, 1999 is not appealable on hardship grounds – one must wait out the revocation period and then seek a driver's license.

Thus, the distinctions between revocations and suspensions are important.  There are more options for relief with a suspension than a revocation.  Get the assistance of a driver's license reinstatement attorney in determining your best course of action.

I got a dui 3 years ago in illinois i'm getting my cdl in sept and was wondering since i finished my court supervison and did all my classes and paid all my fines. what my chances are of finding a job, i'm thinking of moving to tenn.but i'm just wondering if i wasted my time and money getting my cdl. any answers will be great thanks for looking and helping.

I think you're f*cked. Most employers wouldn't take the chance. Too many people out looking for work, why go with a proven hazard? You might want to see if there is some way to get the conviction expunged, but I doubt it with a DUI.
